Can my son contribute to his own HSA if covered by our HDHP plan?

      I have HDHP insurance thru my job. Then, my husband has HDHP insurance thru his job, plus the 2 kids covered. We’ll max the HSA thru my husband’s job ($8550).

      The oldest son got his own full-time job few months ago with full benefits. But will still be in my husband’s plan until 26, he still lives with us until 2025 for sure.

      Question: Can my son also contribute to his own individual HSA thru his job, even if his HDHP plan is not thru his job?

      I vaguely recall reading somewhere that this is allowed, or is this like a risky loophole?

      Definitely won’t advise him to do it if it’s not allowed or if he’ll get in trouble with his employer or with IRS.

      He already plans to max out his TSP and Roth IRA, and still looking to invest/save.

      Son has been filing his own tax since he started internship 3 years ago.

        I believe the crux to this will be will you claim your son as a dependent on your tax return (this is separate from insurance “dependent”).

        If yes, I don’t believe he will be able to leverage this hsa “loophole” and contribute out to family max in his on hsa.

        If no you won’t claim his as a dependent on your tax return, the plan likely will work.

          A couple of notes: if your son has his own insurance, he can’t contribute to an standard medical FSA while contributing to an HSA.

          Also, he can’t contribute through his employer, so he will pay FICA on that money.

            Filing is own taxes is one thing but is he claiming himself or do you still claim him as dependent?

            When in researched for my daughter if he claims himself he has to do his own HSA and you can’t use your family HSA funds to pay for his medical even if the insurance through parent.

            If you claim him as a dependent then he can’t do his own HSA.

            But look up the IRS rules to confirm. It clearly states qualified medical expenses are for dependents on tax return.
