Cheapest/easiest way to get divorced in Illinois and remove my name from our house?

      Cheapest/easiest way to get a divorce? We have a house but I want him to have it and just get my name removed if possible so he doesn’t have to refinance.

      In Illinois if that matters.

        If you both agree go to the court house get a packet file it and both sign it.

        Mine was free because I am low income the judge waived the fees.

          you can do what is called an uncontested or no fault divorce through a shared lawyer for family law, you draw up the documents and sign, which then goes to a judge who makes a ruling as long as both parties can come to a peaceful agreement.

          You can even file for a no fault divorce online, this is legal and can be done in like 30 minutes as long as you both have all your information handy (assets, income, debt, etc) and then can be sent for finalization.

          This does require you and your ex to sit down together to do this but doesn’t involve a lawyer so it’s cheaper and way faster.

          House wise, there’s something called a mortgage loan assumption, he calls the lender for that, and you need to ask for a release of liability from the lender so they can’ t come after you if he defaults on the loan.

          Or, a mortgage loan modification, some lenders will accept a divorce as a option for a loan modification to change the terms of the loan without refinancing.

          Those are options you can go over with the lender.

              As far as I know… Only way to remove ur name is for him to refinance. Signing a Quit Claim Deed really doesn’t do anything bc IF he were to fall behind on the mortgage, they’re still gonna come to you to pay it.

                Call a local family attorney and get some free advice. It’ll be more accurate than anything you’ll get from social media.

                This should always be the first thing you do.

                  You have to refinance to get your name off the house. Cheapest is to do it yourself through the online court system for your state.

                  I highly encourage you to get half of that house though. When he refinances he can add the half that he owes you back on to his loan.

                  If you have kids you will have to take a parenting class for divorced parents.

                  All in all if it’s not contested, it’ll cost around $500.

                  At least in Iowa that’s the case.

                      My ex and I agreed on everything, so we just sat down and made a list of things and how we wanted to divide them, then went to a lawyer.

                      We never actually met the lawyer, but we discussed everything with his paralegal.

                      She got the paperwork together and we signed.

                      Cost us $400 I think.

                      We could have filed on our own for arounf $175 in filing fees, but we didnt want to mess anything up and is find out 10 years later we were still married

                        He’ll have to refi in order to get your name taken off.

                        Quickest and easiest way to get divorced is to higher a paralegal.

                        Have them do all the paperwork and be done with it

                          You can Quitclaim your part of it to him. It would need to be recorded. I’ve done one in that circumstance and also made a couple of them for my aunt and mom.

                          If you aren’t comfortable doing it on your own go to the title company and they should be able you help you.

                            You can. go to the courthouse and file for a divorce yourself. You can remove your name with a Quit Claim Deed from the title of the property, but he will have to refinance the home loan to remove your name from the mortage with or without having a lawyer involved in the divorce.

                            I would not take my name off a piece of property without him refinancing the property first.

                                Do you have another option for housing? Where I live housing is insane. I don’t think I could buy anything for less than $450k.

                                We would absolutely have to sell our house and split the proceeds to move forward.

                                  Every state has different laws for everything. As suggested by another post on this string – start with calling your local Circuit or Family Court.

                                  Ask if they have any information available, suggestions for free local workshops, etc.

                                  Depending on your personal financial information you may qualify for free or reduced legal representation – or free legal clinics that have attorneys available to help review your forms.

                                    My parents have had multiple lawyers and are still not divorced after 9 years.

                                    They just take their money and do nothing
