Do I have legal standing to challenge a denied job promotion under FEPA in Colorado?

      FAIR EMPLOYMENT PRACTICES ACT (FEPA)
      I have worked for my company 3 years this December. I’ve been in my current role for 1 year (promoted 10/2023). I was recently told that within the contact center I’m at, because of my shift limitations (I have to be done working by 2:30 at the latest Monday-Friday as I have children and am a single mom) I am unable to apply to the other 2 lines of business within the contact center because they cannot make accommodations for the training times; even though I have worked remote my entire employment and also have an understanding of the programs we use.

      The current position I’m in is also a dead end as they do not foresee adding additional teams that would open up promotional opportunities for us. So basically, stuck.

      I had a meeting with my operations manager (bosses boss) to discuss my career and overall growth within the company the last week of September 2024.

      It was during this meeting that she found and encouraged that I apply for an Operations Administrator role that was also just posted the last week of September.

      It is in a completely different side of the business BUT I was told based on my experience that I would meet the requirements to apply.

      On October 1st, my direct supervisor (someone else) put in the request to shadow this particular department.

      They also submitted my signed transfer request form to them (myself, direct supervisor and operations manager). I submitted my application for the role on October 2nd.

      I was not contacted by the hiring manager until October 8th where she requested that I send her the transfer request form and my resume to move along with the process.

      I replied on October 9th after confirming with my direct supervisor that the hiring manager was requesting the transfer form that was already sent off the week prior and was told to relay that message in my response along with a copy of my resume; which I did.

      The hiring manager didn’t respond back until October 14th stating, “at this time we have a very strong internal candidate pool.

      The first step of the process would be to schedule a shadowing session with someone on the team if you were interested.

      Let me know if you are open to that and I will send you their contact info.” Again, we already did this at the start of October.

      In between each email received, I was keeping my direct supervisor and operations manager in the loop. They too were getting frustrated with the back and forth issues and didn’t understand why this was happening.

      The hiring manager blatantly ignored my operations manager on a couple of occasions regarding this via Teams as well.
      I finally had my shadowing session on October 21st – at the time my application status reflected “pending review”.

      The hiring manager just emailed me this morning stating, “At this time, we have decided to move forward with another candidate that has stronger experience related to the role”. I never once got an interview.

      This position also came with an annual compensation rate of up to $50,000 which would have been considered a promotion for me.

      Do I have ANY standing with this from a legal perspective? I’m in Colorado!!

        I doubt it. They seem to have gone with a different candidate. I’m not in CO but federally, there would be no legal recourse.

        It doesn’t sound like there were any promises made to you specifically.

        I would honestly look at other companies if you’re really not happy in the role you are in.
